Who the bond protects
The notary bond protects the public, not the notary. If someone is harmed by a notary’s mistake or misconduct and the surety pays a valid claim, the notary must repay the surety. Optional errors and omissions (E&O) insurance is different: it helps pay claims and legal costs for the notary’s own honest mistakes.
