Workers’ comp, disability, and Paid Family Leave
- Virtually all New York employers must provide workers’ compensation for their employees. A sole proprietor with no employees is not required to carry it (New York Workers’ Compensation Board).
- Under the Construction Industry Fair Play Act, a worker doing construction for a contractor is presumed to be that contractor’s employee unless all three legal tests are met (New York Workers’ Compensation Board).
- Virtually all employers must also provide disability and Paid Family Leave benefits coverage (NY WCB disability and Paid Family Leave).
