When bonds are required
Under Michigan Public Act 213 of 1963 (MCL 129.201–129.212), before a contract exceeding $50,000 for the construction, alteration, or repair of a public building or public work is awarded, the contractor must provide a performance bond and a payment bond. Each bond is in an amount fixed by the governmental unit but not less than 25% of the contract amount. Many owners require more, so check the bid documents.
Payment bond notice and suit deadlines
- 30-day notice. A claimant without a direct contract with the principal contractor must serve notice within 30 days after first furnishing labor or materials.
- 90-day notice. The claimant must give written notice to the principal contractor and the governmental unit within 90 days after last performing labor or furnishing materials.
- One-year suit deadline. No action may be started more than one year after final payment was made to the principal contractor.

Who the bonds protect
The performance bond protects the governmental unit, and the payment bond protects subcontractors, suppliers, and laborers on the project.
How much Michigan contract bonds cost
Performance and payment bonds are usually priced together as a percentage of the bond amount, commonly about 0.5% to 3% based on the contractor’s finances and experience (NASBP).
