What counts as Arizona business
Under A.R.S. § 32-1021, business transacted in Arizona includes collecting from debtors located in Arizona, collecting from an office in Arizona, and collecting for creditors located in Arizona. Update your bond amount at renewal if your income moves into a new tier.
Filing and renewal
The bond is filed with the Arizona Department of Insurance and Financial Institutions as part of the license application, which is completed through NMLS. Bonds are typically renewed each year; if your gross income changes tiers, the bond amount must be updated with the surety (SuretyBonds.com).
What the bond protects
The bond protects the public and clients if the agency violates Arizona’s collection agency laws, such as failing to remit collected funds. If the surety pays a claim, the agency must repay it. Agencies often also carry professional liability coverage to protect themselves.
